About the “Name our Earbuds” Competition

Audeara is proud to present its ground-breaking Earbud product to be released late 2024. The earbuds have been designed with the audiology industry in mind, so we are looking to engage with the industry to name our product. As part of this competition, Audeara has developed product name ideas for entrants to vote on, as well as the opportunity for ideas to be submitted by entrants for consideration. The ultimate decision for the product name will be made by Audeara staff. A single vote or product name submission will be considered as an entry into the competition. All entrants will have their name put into a draw to win an engraved, first edition Audeara Earbud. The engraving may be a short name or initials - to be confirmed with the winner prior to engraving. A winner will be announced on 5 July 2024.

Competition Guidelines

This competition is focussed on engaging with professionals within the Australian audiology industry to name Audeara’s new Earbud product to be released in October 2024. This competition is only available to enter via the competition landing page (https://audeara.com/pages/competition-name-our-earbuds) by Australian audiology industry professionals. The promotion of the competition will be through multiple channels at the discretion of Audeara to include as many Australian audiology industry professionals as possible.

Terms and Conditions of Entry

1. General Conditions

1.1. Submission of an entry into the Competition constitutes acceptance of these Conditions of Entry.

1.2. Entries for the Competition commence at (Promotion Period):

7.00am AEST Wednesday 8 May 2024 to 7.00 pm AEST on Friday 7 June 2024.

No entries will be accepted after the closing date.

1.3. The Promoter is Audeara Limited, Level 1 North Tower, 527 Gregory Terrace, Bowen Hills QLD 4006 (ABN 27 604 368 443).

2. Entry

2.1. Entry is open only to Australian Audiology Industry Professionals.

2.2. Entry is free and no purchase is necessary to enter the Competition.

2.3. To enter, Entrants must either vote on an Audeara Earbuds Product Name OR provide an original idea (“Product Name Submission”) that may be used as the product name.

2.4. Entrants may only enter once. Multiple entries will not be considered.

3. The Prize

3.1. The prize will be an engraved, first edition Audeara Earbud, valued up to $699.00. The engraving may be a short name or initials - to be confirmed with the winner prior to engraving.

3.2. The value of the prize is accurate at the date of commencement of the Promotion Period. The Promoter accepts no responsibility for any variation in the value of the prize after that date. The prize cannot be transferred, exchanged or redeemed for cash. The Promoter retains the right to substitute the prize with a prize of equal or greater value.

3.3. There is no cash alternative to the stated prize, and the prize is not transferable or refundable.

3.4. If the prize remains unclaimed by 7:00 pm AEST Friday 7 June 2024 (the equivalent of one week after the winner will be announced), the Prize Winner will be deemed to have forfeited their prize.

4. How to Win

4.1. All Entrants must either vote on an Audeara Earbuds Product Name OR provide an original idea that may be used as the product name via the competition landing page (https://audeara.com/pages/competition-name-our-earbuds)

4.2. This is a game of chance and skill plays no part in determining the winners. 

4.3. Users will be disqualified from the competition at the Promoter’s discretion if they:

4.3.1. Are open to obvious misuse or misinterpretation

4.3.2. Use profanity or obscene language

4.3.3. Are discriminatory, unlawful, infringing, hateful, or sexually suggestive

4.4. The Promoter’s decision is final, and no correspondence will be entered into, including in the event of a dispute.

4.5. The Promoter reserves the right to validate the authenticity and ownership of entries and to disqualify any Entrant for tampering with the entry process.

5. Product Name Submission Ownership Rights Forfeit 

5.1. By submitting a product name idea ("Product Name Submission") to the “Name our Earbuds” competition, you agree to the following:

5.1.1. Ownership Forfeit: By participating in this competition, you agree to forfeit all ownership rights, including copyright, moral rights, and any other intellectual property rights associated with the submitted idea.

5.1.2. Transfer of Rights: Upon submission of your product name idea, you hereby transfer, assign, and convey all rights, title, without any further compensation or notice.

5.1.3. Indemnification: The participant agrees to indemnify The Promoter from any claims, demands, or actions arising out of or in connection with the product name, including but not limited to claims of infringement of intellectual property rights.

5.1.4. No Confidentiality: The participant acknowledges that the submission of the product name does not create a confidential or fiduciary relationship between the participant and The Promoter, and that The Promoter may disclose or use the submitted product name without any obligation to maintain its confidentiality.

6. Other Conditions

6.1. The Promoter accepts no responsibility for entries not received for any reason, or for any difficulties experienced in submitting an entry to this Competition.

6.2. The Promoter and its associated agencies or companies accept no responsibility for lost, late, stolen, damaged or misdirected entries.

6.3. If any act or omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these Conditions of Entry, the Promoter will not be liable for any failure to perform or any delay in performing its obligations and the Promoter reserves the right (subject to any applicable law) to cancel, terminate, modify or suspend the Competition. Notice of any amendments will be published on Audeara’s website at www.audeara.com

6.4. If for any reason the Competition is not capable of running as planned, due to causes including but not limited to tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of the Competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the Competition.

6.5. The Promoter accepts no responsibility for any tax liability incurred as a result of participating in this Competition. Any tax liability arising as a result of accepting any Prize is the responsibility of the Prize Winner.

6.6. The Promoter will not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained as a result of receiving, taking, or using the prize except for any liability which cannot be excluded by law.

6.7. The Promoter has no control over internet or mobile telecommunications, network lines, bugs, viruses, or server problems, and accepts no responsibility for any problems associated with them, for whatever reason.

6.8. By entering the Competition, the Entrant consents to their personal information being collected. The Promoter is required to collect personal information about the Entrant under the gaming laws in Australia in order to conduct the Competition. The Promoter collects the Entrant’s personal information for the purposes of administering the Competition, notifying and announcing the Prize Winner and receiving from the Promoter’s future communications by email including newsletters, special offers and promotions from Audeara unless otherwise advised by the Entrant, and of marketing the Promoter’s products and services, including by direct marketing techniques. The Promoter may disclose the Entrant’s personal information to third parties including those involved in the administration of the Competition, notifying and announcing the Prize Winner, the supply of the prize, the relevant gaming authorities. If the Entrant does not provide the required personal information to the Promoter, the Entrant cannot enter the Competition. The Entrant may access and correct the personal information about the Entrant held by the Promoter by writing to the Promoter at the address below. By entering this Competition, the Entrant consents to the collection, use and disclosure of his or her personal information as set out in these Terms and Conditions of Entry.

6.9. By entering this Competition, Entrants consent to the use of their information as described and agree that the Promoter may use this information, or disclose it to other organisations that may use it, in any media for future promotional, marketing and publicity purposes without any further reference or payment to the Entrant. Entrants may access, change and/or update their personal information and obtain a copy of the Promoter’s privacy policy by contacting the Promoter on 1300 251 539 during office hours.

6.10. Failure of the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

6.11. The section headings contained in these Terms and Conditions of Entry are included for convenience only, and shall not limit or otherwise affect these Terms and Conditions of Entry.
